Ongoing legal battle over defective ear protection issued to military members

From 2003 to 2015, there were tens of thousands of reports of tinnitus and hearing loss from veterans who used their military issued 3M ear protection.

Kelley & Ferraro Attorney Ed Kelley joined the AWF Union Podcast to talk about the ongoing lawsuit involving the defective ear protection and causing hearing damage or loss from use of the product.

Defective ear protection

The United States military purchased millions of units of ear protection from 3M, which were standard issue by the military to their members. The equipment was to protect the user’s ears from concussive blasts from explosive equipment and loud noise from their weapons being fired.

Years after use, thousands of veterans had reported hearing damage and loss, and tinnitus. It was found that the products were defective and did not stay in place properly, exposing soldiers ears to the loud blasts.

Pursuing a lawsuit against 3M
The case against 3M will be a multidistrict litigation case. Since there were thousands of veterans affected by the faulty equipment across the country, the case will be tried on behalf of everyone involved in one central location.

There will be a few plaintiffs used as an example to get the case moving forward. The case will represent everyone affected.
