Labor lawyer discusses anti-union NLRB decisions

With the Trump Administration stacking the National Labor Relations Board with anti-labor officials, Joyce Goldstein of Goldstein Gragel discussed the NLRB’s anti-worker and anti-union agenda on America’s Work Force Radio Podcast on Aug. 14.

Goldstein, a labor lawyer, first discussed how the single most powerful person at the NLRB is not a board member, but the general counsel. She said the General Counsel holds a gatekeeper role and essentially decides which cases to move forward with and act upon.

She said the Trump-appointed NLRB general counsel has shown an anti-worker, anti-union agenda in recent decisions.

Goldstein pointed to a general counsel proposed rule that would eliminate the requirements of employers needing to provide union organizers with employee contact information. 

She said the explanation for the rule change was weak and does not hold water. The general counsel cited employee privacy as reason for the rule change, which ultimately makes it more difficult for organizers to reach those who would like to organize.

She then highlighted a hypocritical decision from the general counsel that allowed Verizon Wireless to subject employee property, such as cars, phones and lockers to search by the employer.

She blasted the NLRB for using employee privacy as a reason for one rule, while another rule is a blatant invasion of employee privacy.
