The U.S. military is one of the world’s best equipped militaries. However, service members nationwide have suffered damages after using ear protection bought from 3M.
Kelly and Ferraro attorney Brian Schall discussed this case and the legal steps being taken to benefit current service members and affected veterans on America’s Work Force Union Podcast.
3M ear protection and the military
3M produced an ear protection product and sold millions of units to the U.S. military, which distributed the personal protective equipment as standard issue.
The equipment was supposed to protect service members from noise and concussive blasts caused by explosives and heavy artillery. After whistle-blower complaints, the ear protection was exposed as being defective against blasts.
The faulty PPE led to thousands of veterans developing tinnitus. The condition occurs when loud blasts and other noises damage the ear.
The case against 3M
Since veterans and service members throughout the nation have been affected, the case falls under multi-district litigation.
3M developed the product as cheaply as possible, paying less than $1 per unit. The company then sold the PPE to the military at a very high margin.
Ultimately, 3M is arguing that thousands of soldiers misused the PPE, leading to their condition. The case is still ongoing.
